H1B Visa

The H-1B is a nonimmigrant employment visa for foreign nationals working in specialty occupations. These occupations require both theoretical and practical application of highly specialized knowledge, and generally a bachelor’s or higher degree (or its equivalent) in a specific specialty.
A U.S. employer must file the H-1B petition. The foreign worker may only work for the sponsoring employer unless another employer files a new petition. Multiple employers can sponsor the same worker separately. Initial H-1B status is granted for 3 years, with the possibility of an extension for another 3 years.
Spouses and children of H-1B holders may come to the U.S. under H-4 status. They are allowed to study but are not permitted to work.
Foreign nationals may even start their own company and file an H-1B petition through it, if an employer-employee relationship can be clearly established (e.g., the company has control over hiring, firing, pay, and supervision).
Requirements
- U.S. bachelor’s degree or equivalent foreign degree
- Certified Labor Condition Application (LCA) from the U.S. Department of Labor
- Proof that the offered position qualifies as a specialty occupation
