Nationals of certain treaty countries with which the U.S. maintains a treaty can qualify for an E-2 visa or E-2 status by investing a substantial amount (typically between $100,000 and $200,000) in a commercial enterprise in the U.S.
- E-2 visa is issued at U.S. Embassies or Consulates outside the U.S.
- E-2 status applies when changing or extending status inside the U.S.
- Visa duration is usually 2 to 5 years, with status renewals possible every 2 years, as long as the investment remains active.
Benefits and Limitations
- The investor’s spouse and children under 21 are eligible for E-2 dependent status and can live in the U.S.
- The E-2 visa is tied to the life of the business—if the business closes, the visa cannot be renewed, and the investor must leave the U.S.
- The E-2 visa does not lead to permanent residency (green card). Those seeking permanent resident status should consider the EB-5 investor visa program.

- Must be a citizen or national of a qualifying treaty country.
- Must be actively investing or in the process of investing the required capital in a U.S. commercial enterprise.
- The investment must be substantial and sufficient to operate the business profitably—typically around $100,000 to $200,000, but varies by case.
- Income from the investment should be more than nominal (i.e., it should generate significant economic impact).
- The investor must prove that the source of the investment funds is lawful.
